General Terms and Conditions: La Sonrisa - Coaching with horses

1. Definitions

• Client: the natural person or legal entity commissioning La Sonrisa - Coaching with horses for participation in a session, workshop, or coaching program.

• Contractor: La Sonrisa - Coaching with horses, located in Alhaurín el Grande, Spain.

• Participant: the person who actually takes part in a session.

2. General and Risk Acceptance

• Participation in sessions or workshops with horses is entirely at the participant’s own risk. Participants are responsible for their own well-being and safety.

• Horses are living animals and may exhibit unpredictable behavior. By participating in activities, the participant acknowledges the inherent risks of handling horses.

• For minor participants, parents or legal guardians are responsible and indemnify La Sonrisa - Coaching with horses against any claims.

• Participants must always follow the instructions of the coach.

• Entering the premises and stables is at one’s own risk. La Sonrisa - Coaching with horses is not liable for loss, theft, damage to property, or accidents, unless caused by intentional or gross negligence by the coach.

3. Formation of the Agreement

• Sessions: participation is confirmed after written confirmation by La Sonrisa - Coaching with horses via email.

• Client Cooperation: the client must provide all necessary information for the optimal execution of the session or workshop.

4. Cancellation and Changes

4.1 Individual Coaching or Team Building

• Within 24 hours before the start: 25% of the fee for one session.

• In cases of force majeure or exceptional personal circumstances, an alternative date can be scheduled in consultation.

4.2 Cancellation by La Sonrisa - Coaching with horses

• In the event of rain, force majeure, illness of the coach or horses, or other unforeseen circumstances, a new date will be scheduled in consultation at no extra cost to the client.

5. Payment

• Payment must be made in cash at the first appointment.

6. Ownership and Copyright

• All materials, photos, documents, and quotations provided by La Sonrisa - Coaching with horses remain the property of La Sonrisa - Coaching with horses.

• Publication or reproduction without written permission is prohibited.

7. Liability

• La Sonrisa - Coaching with horses is not liable for direct or indirect damage, including personal injury, loss of personal property, or business damage, unless caused by intentional or gross negligence of the coach.

• Total liability is limited to the amount of the relevant service.

• The participant acknowledges that coaching and horse-related activities involve risks and indemnifies La Sonrisa - Coaching with horses against claims unless otherwise stated above.

8. Complaints and Disputes

• Complaints must be submitted in writing within a reasonable period, including name, date, and description of the complaint.

• La Sonrisa - Coaching with horses handles complaints confidentially and responds within 14 working days.

• All agreements are governed by Spanish law; disputes are handled by the competent courts in Málaga, Spain.

9. Privacy and Data Protection

• Data is used exclusively for the execution of the agreement and administrative purposes.

• Data will not be sold to third parties; processing by partners or third parties occurs under strict agreements and security measures.

10. Other Provisions

• La Sonrisa - Coaching with horses reserves the right to modify the terms and conditions. Changes will be communicated in writing or by email to the client.

• By participating in sessions, the participant confirms that they have read and accepted the terms and conditions.
